|Title insurance is risk elimination insurance. It offers protection
against loss from hazards and defects that already exist in the title
to a subject property.
Real estate transactions generally involve substantial amounts of money of the buyer and/or the lender. Title insurance should be utilized in all real estate transactions to protect buyers (and other transferees) and to protect lenders who are depending on real property as security for a loan.
Title insurance protects an owner’s or lender’s financial interest in real property from losses due to legal defects in title, liens and judgments, and matters which could not be discovered in public records, such as missing heirs, fraud, and forgery. Title insurance provides a guarantee that the title to the property being transferred or being used as security for a loan is unblemished and legally valid. This is commonly referred to as a clean and marketable title.
Smart investors will never purchase real estate without an owner’s title insurance policy that includes all endorsements appropriate to the type of property being purchased. By law, regulated lenders cannot depend on a property as security for their loan without a lender’s title insurance policy.
